Patent Due diligence, as the name suggests is concerned with an investigation about a patent /portfolio of patents. Patent Due diligence is often performed prior to Business/ Patent acquisition, so that the potential purchaser knows more about the asset that it is acquiring.
Patent due-diligence investigation generally includes auditing of patent assets for various issues such as
patent enforceability problems
Apart from above mentioned there are many other issues that needs to be checked before deciding about acquiring a patent portfolio such as confirm inventorship / ownership of patents, to reveal if there is any contractual arrangements relating to the patents, such as licenses and material transfer agreements; to check if there are regulatory issues to be addressed etc
Since the due-diligence activities generally concerns a patent portfolio which includes a large number of patents. Therefore, it becomes a costly affair to perform a due-diligence for the complete portfolio.
